In re RealPage, Rental Software Antitrust Litigation


Scott+Scott was appointed co-lead counsel representing renters of residential units nationwide against RealPage and large-scale commercial residence owners and operators alleging an unlawful scheme to decrease competition among landlords related to apartment pricing.  Plaintiffs allege that RealPage contracts with landlords who agree to share with RealPage nonpublic, competitively sensitive information about their apartment rental rates and other lease terms to train and run RealPage’s algorithmic pricing software. This software then generates recommendations on apartment rental pricing and other terms for participating landlords based on the nonpublic pricing and term data. In a free market, Plaintiffs allege, these landlords would otherwise be competing independently to attract renters based on pricing, discounts, concessions, lease terms, and other dimensions of apartment leasing rather than aligning their pricing and terms with other RealPage users.  As a result of defendants’ conduct, renters were deprived of the benefits of competition on apartment leasing terms and millions of Americans were harmed.
