Economic evidence suggests that the distributors’ profits have soared due to this price coordination.
In a healthy and fair market, PVC distributors would have to compete with one another for your business– keeping prices competitive and fair. The Sherman Act protects American businesses and consumers from their suppliers coordinating on price. It is considered the hallmark antitrust law, and the DOJ has said “The Act is fundamental to protecting free markets and promoting economic efficiency, innovation, and consumer welfare.” The Supreme Court has said that “The purpose of the Sherman Act is not merely to promote competition, but to protect the public from the failure of the market.”
